Terms of Service
These Terms govern the sale of QuantumCalc calculators, the provision of subscription services, the use of the AI assistant, and file delivery to a Device on quantumcalcgpt.com (the “Service” or “Store”). The Polish version is legally binding for consumers in Poland; this English text is a courtesy translation.
1. Seller
The seller and service provider is Jan Rudowski, conducting unregistered business activity (działalność nierejestrowana under Polish law), address: ul. Karola Szymanowskiego 5/74, 03-477 Warszawa, Poland, email: [email protected] (the “Seller”, “we”).
The Seller operates as unregistered activity and is not entered in the CEIDG business register; this does not limit the rights granted to consumers.
2. Definitions
- Customer — a person using the Store or placing an order.
- Consumer — a natural person entering a contract not directly related to their business or profession.
- Device — the QuantumCalc calculator (ESP32-based hardware).
- Subscription — a paid digital service providing access to the AI assistant on the chosen plan.
- AI Service — the feature that generates answers and calculations via an AI model.
- User Content — files, images, documents, text and other content uploaded by a Customer through the Service.
- Account — the Customer's individual profile in the Service.
3. Technical requirements
To use the Service you need: a device with internet access, an up-to-date browser with JavaScript and cookies enabled, and an active email address. Using the Device requires an internet connection and an active Subscription linked to it.
4. Account
Creating an Account is voluntary and free. The Customer agrees to provide accurate data and to protect their login credentials. You can delete your Account at any time in your dashboard or by contacting the Seller.
5. Conclusion of the sales contract
Information about Devices in the Store is an invitation to conclude a contract, not an offer in the meaning of the Civil Code. The contract is concluded when the Seller confirms acceptance of the paid order. The Customer receives confirmation by email.
6. Prices and payments
Prices are stated in Polish złoty (PLN) and include all mandatory components. Payments are handled by Stripe (card and other available methods). The Seller does not store card details.
As unregistered activity, the Seller is generally not a VAT payer; on a Consumer's request we issue a sales receipt (rachunek).
7. Delivery
Devices are delivered within Poland via InPost (parcel lockers or courier). Cost and estimated delivery time are shown during checkout. The risk of accidental loss or damage passes to the Consumer upon handover of the item by the carrier.
8. Subscription and AI Service
- The Subscription is a digital service billed on a recurring basis (e.g. monthly) according to the chosen plan and renews automatically until cancelled.
- You may cancel anytime in your dashboard; access continues until the end of the paid period and the next period is not charged.
- Plans may include usage limits (e.g. number of prompts or tokens). Misuse or excessive load may result in access restrictions.
- Upgrades and downgrades follow the terms shown in your dashboard (including pro-rata settlement where applicable).
9. User Content and file delivery to a Device
The Service lets you deliver a supported file to a user-confirmed Device. You retain your rights in User Content. You grant us only a non-exclusive, royalty-free and limited technical licence, lasting for the time needed to perform the transfer, to receive, inspect, format-convert, compress, temporarily store, reproduce and deliver User Content to the selected Device, and to perform acts necessary for security and fault recovery. This licence does not permit us to use that content for advertising or AI-model training. Uploading a file for Device delivery does not by itself send it to an AI-model provider.
You may upload only content for which you have the necessary rights or permission. You must not upload content that:
- is unlawful or infringes another person's rights, including copyright, trade mark, privacy, personality or data-protection rights;
- contains malicious code, is intended to disrupt the Service or Device, or attempts to bypass security controls;
- depicts child sexual abuse, contains unlawful threats, or is otherwise unlawful to possess or distribute.
We may block a transfer, remove a temporary copy, or restrict access to the feature where reasonably necessary to comply with law, protect the Service or Device, or respond to a credible infringement report. We do not proactively review every file. If you believe content transferred through the Service infringes your rights, use the content-reporting procedure. These rules do not limit a Consumer's rights under mandatory law.
10. Nature of the AI Service and liability
The AI assistant is an aid. AI-generated answers and calculations may be inaccurate or wrong and do not constitute professional (mathematical, financial, legal or other) advice. You should independently verify important results. We make reasonable efforts to keep the service working but do not guarantee uninterrupted, error-free availability; technical and maintenance interruptions may occur.
11. Right of withdrawal (14 days)
A Consumer may withdraw from a distance contract within 14 days without giving a reason.
Device: the period runs from taking possession of the item. To withdraw, send an unambiguous statement (e.g. by email to [email protected] or via the function provided in the Service). Return the Device no later than 14 days after withdrawal. We refund all payments received (including the cheapest offered delivery) promptly, no later than 14 days. The Consumer bears the direct cost of return and is liable for any reduction in the item's value resulting from use beyond what was necessary to establish its characteristics and functioning.
Subscription (digital service): if you request that performance begin before the withdrawal period ends, we ask for your express consent and acknowledgement that you lose the right of withdrawal once the service is fully performed. If you withdraw during a billing period, you pay for performance rendered until withdrawal (pro rata).
A model withdrawal form is available on request; it is not mandatory.
12. Complaints (lack of conformity)
The Seller must deliver a Device that conforms to the contract. Where goods or a digital service do not conform, the Consumer has the rights set out in the Polish Consumer Rights Act (Chapters 5a and 5b) — in particular repair, replacement, price reduction or withdrawal on the terms stated there.

13. Out-of-court dispute resolution
A Consumer may use out-of-court methods of handling complaints and pursuing claims — e.g. turning to the district (municipal) consumer ombudsman, the regional Trade Inspectorate, or a relevant consumer organisation. Information is available at the Office of Competition and Consumer Protection (uokik.gov.pl). The EU ODR platform was discontinued in 2025.
14. Personal data
How we process personal data is described in the Privacy Policy.
15. Changes and final provisions
We may amend these Terms for valid reasons (e.g. changes in law or service scope). We will announce changes in the Service or by email; contracts already concluded are governed by the Terms in force at the time. Matters not covered here are governed by Polish law, in particular the Civil Code and the Consumer Rights Act. These Terms do not limit Consumer rights under mandatory law.
